These terms govern your use of winkingtoad.com (the "Service"). By creating an account or using the Service as a guest, you agree to them. If you don't agree, don't use the Service.
1. The Service
Winking Toad crawls websites and reports SEO, technical, and content issues, and offers tools to help review and apply fixes — directly on supported platforms (Shopify, WordPress, Webflow, BigCommerce, Magento) where you connect your own credentials, or as copy-paste guidance for any other site. A free tier and a paid subscription tier are offered; paid-tier billing is handled by Razorpay.
2. Accounts
- You must provide accurate registration information and keep your login credentials secure. You're responsible for activity under your account.
- You must be legally able to enter a binding contract to register an account.
- We may suspend or terminate an account that violates these terms, abuses the Service, or is used for unlawful activity.
3. Acceptable use
You agree to only crawl websites you own, control, or are otherwise authorized to crawl. You agree not to:
- Use the Service to attack, probe, or gain unauthorized access to any system, including by attempting to route crawls at internal/private network addresses you don't control.
- Use the Service to violate any law, or any third party's rights (including a crawled site's own terms of service or robots.txt directives where legally binding).
- Attempt to circumvent usage limits, rate limits, or credit metering.
- Resell or provide the Service to third parties without our written permission.
- Use AI-powered features (AI Visibility, Content Rewrite) to generate content that is unlawful, defamatory, or that you don't review before publishing — AI-drafted content can be factually wrong, and you're responsible for what you actually publish.
4. Direct-apply CMS fixes
Features that write directly to a connected Shopify, WordPress, Webflow, BigCommerce, or Magento store act only on the credentials and store you provide, only for changes you review and approve. You're responsible for the credentials you connect and for reviewing changes before approving them. We log applied changes to support undo, but undo can fail if the content was independently modified after the fix was applied — we're not liable for content changes made through this feature, reviewed and approved by you.
5. Billing, plans, and cancellation
- Paid subscriptions are billed monthly or yearly in advance through Razorpay, at the price shown at checkout.
- You can cancel anytime from your account; cancellation takes effect at the end of the current billing period, and you keep paid-tier access until then.
- Some features are metered separately using a credit balance, deducted per use as described where the feature is offered. Credits are non-refundable except where required by law or described in our Refund & Cancellation Policy.
- We may change prices for future billing periods; we'll make reasonable efforts to notify active subscribers before a price change takes effect for them.
6. Your content and data
You retain ownership of the data you submit and the crawl results generated from sites you crawl. You grant us a license to store and process that data solely to provide the Service to you. See our Privacy Policy for how we handle data.
7. Disclaimers
The Service is provided "as is." Crawl results, issue detection, SEO scores, and AI-generated content are informational and heuristic — they are not a guarantee of search ranking, indexing outcome, or legal/regulatory compliance. We don't guarantee the Service will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by law, Winking Toad is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including damages from crawl inaccuracies, AI-generated content, or CMS changes you approved. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.
9. Changes to these terms
We may update these terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where required, notify active subscribers.
